RUWireless terms of service for guest internet access


The purpose of this service is to provide free public wireless Internet access ("the Service") to visitors of Rutgers, The State University of New Jersey ("Rutgers"). You may use the Service only if you agree to the following terms of service ("TOS") each time you access the Service. Rutgers students, faculty and staff must use the secure wireless service by selecting "I have a NetID and password" above.

Access

Access to the Service is at the full discretion of Rutgers and may be blocked, suspended, or terminated at any time for any reason including, but not limited to, violation of this Agreement, actions that may lead to liability for Rutgers University, disruption of access to other users or networks, or violation of applicable laws or regulations. Rutgers may revise the TOS at any time. You must accept these TOS each time you use the Service and it is your responsibility to review it for any changes. This is an open wireless network that provides NO privacy for your data. The Service should not be considered private or protected. All communications over the Service are subject to monitoring. Rutgers reserves the right to limit throughput or access.

Acceptable Use

By using the Service and any activities conducted through the Service, you are agreeing not to violate any applicable law or regulation or the rights of Rutgers, or any third party. Rutgers cannot accept any responsibility for any injury or loss that results from inaccurate, unsuitable, offensive, or illegal Internet communications.

Disclaimer

All data, hardware, software, and documentation provided as part of the Service is provided “as is” without warranty of any kind, either express or implied. This disclaimer of liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. You, the User, specifically acknowledge that Rutgers is not liable for your defamatory, offensive, infringing or illegal materials or conduct, or that of third parties, and Rutgers reserves the right to terminate your access with or without notice at any time with or without cause and without liability.

Disavowal of Liability

Under no circumstances, shall Rutgers or anyone else involved in administering, distributing or providing the Service, be liable for any indirect, incidental, special or consequential damages, including without limitation, loss of revenues or lost profits, or damages that result from the use of or inability to use the Service, mistakes, omissions, interruptions, delegation or deletion of files or e-mail errors, defects, viruses, delays in operation or transmission, failure of performance, theft, destruction or unauthorized access to the User’s records, hardware, software, peripherals, programs or services, even if the User has been advised of the possibility of such losses. The User is expressly placed on notice that the Service provided by Rutgers comes without the protection of a firewall or other such security.
